SECTION A - TITLE OF AGREEMENT, COVERAGE PURPOSE AND OBJECTIVES

1. Purpose

1.1 This Agreement provides the terms and conditions of employment for non-SES Public Service Act 1999 employees of the Australian Electoral Commission (AEC), who are not covered by an Australian Workplace Agreement.

1.2 This Agreement supports the achievement of the following AEC outcomes, namely:

  • an effective electoral roll;
  • an impartial and independent electoral system; and
  • an informed community.

2. Objectives

2.1 The shared objectives of this Agreement are to:

  • provide equitable remuneration and competitive and flexible working arrangements;
  • ensure that the AEC is able to attract, retain and develop high quality, productive employees;
  • assist in the delivery of high quality, independent electoral services that meet customer needs and encourage their participation in the electoral process;
  • implement effective learning and development that enhances individual leadership capabilities and helps increase organisational effectiveness;
  • work together cooperatively on AEC structures, functions and business processes to enhance organisational performance and promote the development of a sustainable organisation for the future;
  • build on our performance management framework to promote enhanced feedback on performance, targeted development and recognition of excellence;
  • value and promote diversity as an organisational capability that also enhances our relationships with our customers and stakeholders;
  • promote a safe and healthy workplace; and
  • adhere to the APS Values and Code of Conduct.

3. Coverage And Persons Bound

3.1 This Agreement applies to all non senior executive APS employees of the Australian Electoral Commission who are employed under the provisions of the Public Service Act 1999 but does not apply to the following:

  • any employee who is party to an Australian Workplace Agreement with the Australian Electoral Commission entered into on, or before, the commencement of operation of this Agreement notwithstanding that the Australian Workplace Agreement may have passed its nominal expiry date; and
  • any employee who becomes a party to an Australian Workplace Agreement.

3.2 This Agreement binds:

  • the Electoral Commissioner, as the employer;
  • all persons whose employment is, at any time when the Agreement is in operation, subject to the Agreement; and
  • the Community and Public Sector Union.

4. Duration

4.1 This Agreement will commence operation from the date of lodgement with the Office of the Employment Advocate and will have a nominal expiry date of 3 years from the date of lodgement.

5. Operation of Agreement

5.1 This Agreement constitutes a closed agreement in settlement of all matters for its duration. For the life of the Agreement, there will be no further claims in relation to the period of the Agreement that would increase labour costs except where consistent with the terms of this Agreement.

5.2 Without incorporating the terms of any legislation into this Agreement, it is acknowledged that employment in the AEC is subject to the provisions of various Acts (and regulations or instruments made under those Acts) as in force from time to time, including:

  • Long Service Leave (Commonwealth Employees) Act 1976
  • Maternity Leave (Commonwealth Employees) Act 1973
  • Occupational Health & Safety (Commonwealth Employment) Act 1991
  • Public Service Act 1999
  • Public Employment (Consequential and Transitional) Amendment Act 1999
  • Safety, Rehabilitation and Compensation Act 1988
  • Superannuation Act 1976 - Superannuation Act 1990
  • Superannuation Act 2005
  • Superannuation Benefits (Supervisory Mechanisms) Act 1990
  • Superannuation Productivity Benefit Act 1988,
  • Veterans Entitlements Act 1986, and
  • Workplace Relations Act 1996.

5.3 There are guidelines/policies and procedures which prescribe conditions for working in the agency. Employees should make themselves familiar with these guidelines/policies which may be varied from time to time and which will apply in the form they are in as at the time of any relevant action/decision. For assistance, particular guidelines/policies are identified in the relevant clauses throughout this Agreement. If there is any inconsistency between the guidelines/policies and the express terms of this Agreement, the express terms of the Agreement prevail.

5.4 Employees have access to dispute resolution and review of action provisions outlined in Appendix A - Dispute Resolution and Appendix B - Review of Employment Related Actions.

6. Australian Workplace Agreements

6.1 The Electoral Commissioner may enter into Australian Workplace Agreements (AWAs) with employees covered by this Agreement.
